Proiect de lege📌Initiativa legislativa inedita de modificare a Codului Muncii

De acesta data, propunerea de modificare a Codului Muncii este una substantiala si care ar aduce schimbari mari in felul cum muncim. Sunt introduse notiuni noi care ar permite mai mult timp liber sau organizarea diferita a timpului de lucru ori comprimarea lui, dar sunt si definite formule care se practicau deja pe piata muncii, in functie de specificul activitatii desfasurate.


Se propune:

- un program de munca flexibil, bazat pe banca orelor de munca efectuate de un salariat, cu acordul sau, la solicitarea salariatului;

- stabilirea prin contractul de munca a duratei timpului de munca, exprimata ca numarul total de ore ce urmeaza a fi prestat de salariat intr-o luna. Aceasta va reprezenta banca orelor de munca;

- Angajatorul si salariatul pot conveni ca orele de munca sa fie prestate la sediul angajatorului, de la domiciliul salariatului sau in alt loc decat locul de munca organizat de angajator, folosind tehnologia informatiei si comunicatiilor;

- Saptamana de lucru comprimata: cumularea orelor de munca astfel incat, la finalul saptamanii, angajatului sa ii rezulte o zi in plus de repaus saptamanal;

- Munca in regim de garda/”on call”: Pe toata perioada muncii in regim de garda salariatul va fi la dispozitia angajatorului; poate lucra cu norma intreaga sau cu timp partial.

- Munca in regim de permanenta: repartizarea programului de lucru, in ture lungi de doua sau trei saptamani, in care salariatii nu vor putea parasi perimetrul locului de munca al angajatorului, fiindu-le asigurata hrana si cazarea.

- Partajarea locului de munca: crearea unui singur loc de munca in organigrama angajatorului, avand atributiile specifice postului partajate intre salariatii care vor imparti acest post in functie de abilitatile si competentele acestora; Pot indeplini:

  • atributii diferite ale aceluiasi post sau

  • aceleasi atributii.

- Anul de lucru comprimat: prin CIM se va repartiza programul de lucru, astfel incat din comprimarea lunilor de munca salariatului sa ii rezulte o luna sau maxim doua in plus de timp de repaos;

- Partajarea programului de munca: In cazul intreruperii sau reducerii temporare a activitatii, fara incetarea raportului de munca, pentru motive economice, tehnologice, structurale, similare sau pe perioada starii de urgenta/ alerta/asediu, pe perioade care depasesc 15 de zile lucratoare, angajatorul va avea posibilitatea reducerii programului de lucru pe zi sau saptamana, cu reducerea corespunzatoare a salariului.

  • Pana la remedierea situatiei care a cauzat reducerea programului, dupa consultarea prealabila a sindicatului;

- introducerea de noi cazuri de suspendare prin acordul partilor, prin modificarea art. 54, dupa cum urmeaza:

c) pe perioada vacantelor scolare;

d) pe perioada suspendarii cursurilor institutiilor de invatamant prin decizii ale autoritatilor competente;

e) pe perioada ingrijirii sotului sau unei rude pana la gradul III inclusiv, demonstrate prin certificate de concediu medical al persoanei in cauza.

Durata maxima: 3 luni/anual

Proposals:

- a flexible work schedule, based on the bank of working hours performed by an employee, with his consent, at the request of the employee;

- establishing through the employment contract the duration of the working time, expressed as the total number of hours to be provided by the employee in a month. This will represent the working hours bank;

- The employer and the employee may agree that the working hours be provided at the employer's premises, at the employee's home or in another place than the work organized by the employer, using information and communication technology.

- Compressed work week: the accumulation of working hours so that, at the end of the week, it results for the employee an extra day of weekly rest;

- Work on duty / "on call": During the entire period of work on duty, the employee will be available to the employer; they can work full time or part time;

- Permanent work: distribution of the work schedule, in long shifts of two or three weeks, in which employees will not be able to leave the perimeter of the employer's workplace, being provided with food and accommodation.

- Job sharing: creating a single job in the employer's organization chart, having the specific duties of the job shared between the employees who will share this job depending on their abilities and competencies; They can have:

  • different attributions of the same position or

  • the same attributions.

- Compressed work year: the CIM will distribute the work schedule, so that the compression of the employee's work months will result in a month or maximum two of free time, in addition.

- Sharing the work schedule: In case of temporary interruption or reduction of activity, without termination of employment, for economic, technological, structural, similar reasons or during the state of emergency / alert / siege, for periods exceeding 15 working days, the employer will have the possibility to reduce the work schedule per day or week, with the corresponding reduction of the salary.

  • Until remedying the situation that caused the reduction of the program, after prior consultation with the union;

- modification of art. 54 - Suspension by agreement of the parties: new cases are introduced:

c) during the school holidays;

d) during the suspension of the classes of the educational institutions by decisions of the competent authorities;

e) during the period of looking after the husband/a relative up to the third degree inclusive, demonstrated by medical leave certificates of the person in question.

Maximum duration: 3 months / year
